California Consumer Privacy Act (CCPA) Notice

This CCPA Notice supplements the information contained in our Privacy Policy and applies solely to visitors, users, and others who reside in the State of California ("consumers" or "you"). We adopt this notice to comply with the California Consumer Privacy Act of 2018 ("CCPA") as amended by the California Privacy Rights Act of 2020 ("CPRA"), and any terms defined in the CCPA/CPRA have the same meaning when used in this notice.

Information We Collect

ByrdByte Creations Inc. collects information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household ("personal information"). We have collected the following categories of personal information from consumers within the last twelve (12) months:

  • Identifiers: Name, email address, postal address, phone number, account name.
  • Commercial Information: Records of products purchased, purchase history, order details.
  • Internet or Network Activity: Browsing history on our Site, search history, interaction with our website and advertisements.
  • Geolocation Data: Approximate location based on IP address.
  • Professional Information: Partner Program participation data, commission history, payment method details.

Use of Personal Information

We may use or disclose the personal information we collect for one or more of the following purposes:

  • To fulfill or meet the reason you provided the information (e.g., processing orders, shipping products).
  • To process Partner Program applications, commissions, and payouts.
  • To provide, support, personalize, and develop our Site, products, and services.
  • To communicate with you, including for customer service, marketing, and promotional purposes.
  • To detect security incidents, protect against malicious or fraudulent activity, and prosecute those responsible.
  • To comply with legal obligations.

Sale of Personal Information

We do not sell your personal information. In the preceding twelve (12) months, ByrdByte Creations Inc. has not sold personal information of consumers. We do not sell the personal information of minors under 16 years of age.

Your Rights Under the CCPA

As a California resident, you have the following rights:

  • Right to Know: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which personal information is collected, the business purpose for collecting personal information, and the categories of third parties with whom we share personal information.
  • Right to Delete: You have the right to request that we delete any personal information about you that we have collected, subject to certain exceptions.
  • Right to Correct: You have the right to request that we correct inaccurate personal information that we maintain about you.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. We will not deny you goods or services, charge you different prices, provide you a different level of quality, or suggest you may receive a different price or level of quality.
  • Right to Opt-Out of Sale: As stated above, we do not sell your personal information. If our practices change, we will update this notice and provide you with an opt-out mechanism.

Exercising Your Rights

To exercise any of the rights described above, please submit a verifiable consumer request to us by:

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information (or an authorized representative), and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will respond to your verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and extension period in writing.
